3.1 Account Creation: You must provide accurate, current, and complete information during registration and maintain and update such information to keep it accurate, current, and complete.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Authorized Use: You represent and warrant that you are an authorized educator or educational institution representative and that you have the authority to use the Service on behalf of your educational institution, if applicable.

4.1 FERPA Compliance: GrAIdbooks is designed to comply with the Family Educational Rights and Privacy Act (FERPA). We act as a "School Official" with a legitimate educational interest when processing student data on behalf of educational institutions.

4.2 COPPA Compliance: When student data includes information from children under 13, we comply with the Children's Online Privacy Protection Act (COPPA). Educational institutions using our Service are responsible for obtaining necessary parental consent as required by COPPA.

4.3 Data Ownership: Educational institutions and educators retain ownership of all student data submitted to the Service. GrAIdbooks does not claim ownership of student data.

4.4 Data Use: Student data is used solely for the purpose of providing educational assessment services. We do not use student data for advertising or marketing purposes, nor do we sell student data to third parties.

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload or transmit any content that is harmful, offensive, or violates the rights of others
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems to access the Service without authorization
• Share your account credentials with unauthorized parties
• Use the Service to violate student privacy or educational data protection laws

The Service, including its original content, features, and functionality, is owned by GrAIdbooks and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit to the Service, including student work and assessment materials. By submitting content, you grant GrAIdbooks a limited, non-exclusive license to use, store, and process such content solely for the purpose of providing the Service.

7.1 Subscription Terms: Access to the Service requires a paid subscription. Subscription fees are billed monthly in advance. All fees are non-refundable except as required by law.

7.2 Automatic Renewal: Your subscription will automatically renew each month unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

7.3 Price Changes: We reserve the right to modify subscription prices. Price changes will be communicated to you in advance and will apply to subsequent billing cycles.

We strive to provide continuous access to the Service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any aspect of the Service at any time with or without notice.

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. Your continued use of the Service after any changes constitutes acceptance of those changes.

9.1 Data Retention: We retain student data and educational content for as long as necessary to provide the Service and as required by applicable laws and regulations.

9.2 Data Deletion: Upon account termination or upon request, we will delete or return student data in accordance with applicable laws, including FERPA. You may request data deletion at any time through your account settings or by contacting us.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAIDBOOKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, we will delete or return your data in accordance with our Privacy Policy and applicable laws.
